KANHAIYA KUMAR IS NOT A HERO
Previously i have updated two status pertaining to Sedition Charge against Kanhaiya and his consequent arrest.Going through various judgments of the Supreme Court of India and the Supreme Court of the United States,i observed that Sedition Charge is not made out as per contents of FIR and also observed that arrest of Kanhaiya was illegal.I still stand with my observations.Expulsion in the nature of disciplinary measure has been recommended against him and others by the Inquiry Committee of JNU,which i think unfair and unjust.
He is the victim of "Terror Of Law" but he is not a hero.Though being a victim of "Terror Of Law",he is not an advocate of "Rule Of Law."
"Rule Of Law" can never be established by participating in such programme which was prearranged to assemble for sloganeering in favour of Afazal Guru and Maqbool Bhat.Those who endeavour towards establishing "Rule Of Law" can only be hero.
I am not in a position to state execution of Afzal Guru and Maqbool Bhat wrong or right.But i am in a position to state that sloganeering is not a proper act (However also not a criminal act) to protest against execution of Afzal Guru and Maqbool Bhat.If any segment of society are dissatisfied from the execution, they ought to strive towards Judicial Review of the matter by "the Whole Judges Bench" of the Supreme Court.If the Supreme Court refuses to review by the Whole Judges bench or people are aggrieved by the reviewed decision,then they should endeavour towards "Open Public Judicial Review."
"Open Public Judicial Review"may be referred as "Judicial Referendum." Those who want to vote,may cast vote with their judicial opinions leading to their conclusion in Pros And Cons of Afzal Guru and Maqbool Bhat.Voting without judicial opinions shall not be entertainable because it's not only a referendum,it's a judicial referendum.Decision will be taken on the basis of Majority of voting with judicial opinions.It's a concept of pronouncing Judgment in a democratic way.We only elect our representatives by voting in a democratic way.We don't pronounce judgments in a democratic way by voting with judicial opinions.
