Sub:- Request for ensuring independent enquiry in the matter of my all cases pending before you all authorities against the Principal Of Jawahar Navodaya Vidyalaya,Birauli, Samastipur and intimation of my Indefinite fast from 13 Aug 2014 until independent enquiry team is not constituted-Regarding.

It is to inform you all that my some cases are pending before you all authorities wherein no expected action has been taken till now.

A brief summary of these all cases is presented before you all:-

1.The Central Vigilance Commission has directed Sh.Amit Khare, The Chief Vigilance Officer of the Ministry Of Human Resource and Development vide its OM No.014/EDN/038/246381 of dated 8/5/2014 (Complaint No.231/2014/Vigilance7) to enquire into the allegation against Chiranjiwi Roy, the Principal Of Jawahar Navodaya Vidyalaya,Birauli, Samastipur for getting his two sons admitted fraudulently and submit factual report before the commission in exercise of the power vested under section 17(1) of the CVC Act,2003.I have been informed by a letter of Vigilance Section of the Ministry vide FTS -29794/14 of dated 20 June 2014 that my complaint has been forwarded to Sh.PK.Mittal ,Director of UT-III section of Department Of Higher Education of the Ministry vide FTS 53132/14 of dated 2 June 2014 to look into it and submit an action taken report before the vigilance section.

Under section 8(1)(h) of the CVC Act,2003 , the Commission has only the power to exercise superintendence over the vigilance administration of the various Ministries of the Central Government or corporations established by or under any Central Act, Government companies, societies and local authorities owned or controlled by that Government. Sh.P.K Mittal is not an officer of the vigilance section of the ministry and the Commission has no power to exercise superintendence over him, therefore my complaint should not have been forwarded to Sh.P.K. Mittal and the Chief Vigilance Officer or the subordinate officer of the Vigilance section should have taken keen interest to enquire into my allegation in accordance with the provision of the CVC Act,2003.

2. The National Human Rights Commission vide its Case No.3332/4/30/2013/OC of dated 27 Nov 2013 directed the The Secretary,Department of School Education and Literacy,Ministry Of Human Resource and Development ,Govt Of India to take appropriate necessary action in respect of my complaint against the said principal wherein he has been accused of violating human rights of the many students. Unfortunately, the Ministry forwarded the complaint to the Commissioner, Navodaya Vidyalaya Samiti and a letter was sent to me by Sh.G.Arumugam, the Deputy Commissioner(Acad) of NVS vide F.No.27-7/2012-NVS (Acad) of dated 6/1/2014 wherein he has quashed my all allegations without enquiring into the allegations either through taking evidences from me or taking statements of the presented victimized students. However, I approached to the Ministry and the ministry again sent the letter to the NVS Commissioner vide No.F.27-1/2014-UT-III of dated 15/4/2014 wherein my demand has been pointed out to the NVS Commissioner to enquire into the allegation through an independent enquiry team. But no enquiry has happened till now. In the meanwhile on dated 21/4/2014,I sent all evidences to Sh.MS. Khanna, Joint Commissioner(Personal) by pointing out the malpractice done by Sh.G.Arumugam but no reply came till now either from MS. Khanna or NVS Commissioner. The Deputy Commissioner Of NVS Patna sent me a letter vide F.No.2-2/S.A(01)/NVS(PTR)/2013-14/7697 of dated 3 Feb 2014 and sought evidences from me against the said principal. I sent him all evidences on 21.4.2014 but no reply came till now.

3.It is pertinent to mention here that there no leaves any way to save the said principal besides the way of not replying or not considering upon my evidences or not enquiring or enquiring through junior officials. So, these all malpractices are being done by you all respondent authorities. If there will be independent enquiry or if my evidences will be considered ,then the said principal will got caught. So you all have made an idea to not do what can be expected from the applicant.

4.Further, it is to inform you all that I will be on indefinite fast from 13 Aug 2014 until Independent Enquiry Team is not constituted in all these cases.

Therefore, it is requested to constitute independent enquiry team in all these cases at the earliest and consider my all evidences.
