I closely experienced and acted accordingly as to what must prevail when the conflict occurs between Nature,Law,Govt and Society while representing affected farmers of my village in connection with embankment construction without land acquisition.
I,with the cooperation of some affected farmers of village,could be able to disobey the arbitrariness of Govt and traditional mindsets of Society for the Protection of Law and interest of affected farmers,but couldn't be able to protect the law against the natural crisis.Law must always prevail against the arbitrariness of Govt and traditional mindsets of Society,but Nature shall always prevail against the Law.
It is very unfortunate that for what objectives i,with the cooperation of farmers,rised voice could not be attained due to meantime intervention of the nature.It was targeted to not let the govt agency construct the embankment without land acquisition which was against the mindsets of Society,except some affected farmers.
In Ravi Season of 2015-16,we could be able to stay the embankment construction in our village due to unity among some affected farmers and by approaching to the Collector-cum-District Magistrate,High Court etc and embankment construction got postponed before entering into our village.Stay of embankment construction protected standing crops of more than 200 acres,giving aggregate benefit to farmers of more than one crore rupees.
The distance between last point of embankment where stayed and its parallel Kamla Balan River would only be 100 meters and Construction agency deliberately, intentionally and under conspiracy cut soil 5-7 feet deep beyond the permissible limit of 2 feet from the embankment to the bank of river so that through this 5-7 feet deep ditch the river can create a new path and samething happened.Soil cutting of 5-7 feet beyond permissible limit has been supported by the Draft Social Impact Assessment Report of the Asian Development Research Institute, Patna.Two relevant pages of the said report are attached herewith.
River created a new path of more than 100 meters which might be expanded if it would not be blocked by constructing embankment through that place.Further sand spreaded in more than hundred acres of land in the course of creation of new path by the river due to flood.Considering above natural crisis, before cultivation in this Ravi Season 2016-17,we agreed to let the embankment constructed without any obstruction.
If it would be project for University,Hospital, Road etc which would not cause natural crisis,we would not give them to start project without land acquisition.
