A lot of things i have experienced in legal and social fields since discontinuance.
A brief account of some events of legal importance being result of my RTI,other applications and efforts are enlisted hereunder in chronological descending order which i will discuss in details as far as possible:-
1.Dated 13/1/2017:-The Central Information Commission directed the Purnea Unit of Power Grid Corporation of India Limited to designate the Public Information Officer or the Assistant Public Information Officer,as the case may be,to this unit.An envelope containing RTI Application inside was returned by the Postal Official edorsing that there was no Public Information Officer in this unit,which was in contravention of sections 5(1) and 5(2) of the RTI Act,2005.
2.Dated:10/01/2017:-The Central Information Commission directed the Navodaya Vidyalaya Samiti,Regional Office,Patna to provide information regarding transfer policy of Principal. Actually when i rised this issue,then Dr C Roy was holding post of principal in JNV Samastipur since 8 years which was beyond permissible period of 5 years.NVS had erroneously refused to provide information regarding rule as to transfer of principal by wrongly citing judgement of the Bombay High Court in Celsa Pinto vs Goa State Information Commission.Direction of the Commission makes it clear that the Judgement of Bombay High Court was wrongly cited only to save Dr C Roy.
3.Dated 03/12/2016:Public Hearing was conducted in my revenue village Sughrain in the presence of Special Land Acquisition Officer,Koshi Project,Darbhanga and team of ADRI,Patna headed by one Retired IAS Officer in connection with Social Impact Assessment for the purpose of land acquisition necessitated for embankment construction.I attended this hearing by going to village from Varanasi during exam time of LL.B (Hons) 1st Semester.All important suggestions made by me and my villagers have been incorporated in Draft SIA Report and this report especially mentions my name and suggestions.
4.Dated 15/11/2016-The Central Information Commission directed the IISER,Bhopal to provide the Information seeking cut-off,merit list and result list of admission in the Institute as these things are not disclosed and admission happens also through 'back door'.The IISER, Bhopal replied that Admission is conducted by the Joint Admission Committee,IISERs but refused to transfer to the Joint Admission Committee,IISERs which was in contravention of section 6(3) of the RTI Act,2005.
5.Dated 11/11/2016:The Public Information Officer,Department of Personal and Training,Govt of India appeared before the Central Information Commission and apprised the Commission regarding present difficulties in establishment of Lokpal.However, the difficulty arising out of vacancy of Leader of Opposition in the Loksabha necessitated for Selection Committee of Lokpal has been recently rejected by the Supreme Court.Earlier,the Public Information Officer of DoPT had refused to provide information in this regard on RTI Applications of four persons including me.
6.Dated 20/06/2016 & Dated 2/12/2015:The Election Commission of India informed me in regard to my email and RTI Application that Chief Electoral Officers of 9 states were directed before State Legislative Assemblies elections to aware people about NOTA in pursuance of the direction of the Supreme Court in PUCL v Union of India,dated 27/09/2013.But from the date of judgement of Supreme Court i.e.27/09/2013 to the date of reply to me i.e.20/06/2016 legislative assemblies election had happened in 20 states and out of 20,Chief Electoral Offiers of only 9 states were directed and besides direction nothing happened for awareness about NOTA even in these 9 states.It may be concluded that Election Commission of India is violating the direction of the Supreme Court.
7.Dated 15/03/2016:RTI Reply reveals that there is no official circular to bar to provide plate of Ultrasonography which is being done in the Govt Hospitals of Bihar,as Ultrasonography is done free of cost and plate is not provided but there is no provision to refuse to provide plate.
8.Dated 30/10/2015:The Central Information Commission heard on returning of RTI Application with Postal Order by Ministry of Health & Family Welfare,Govt of India due to addressing Postal Order to the Secretary instead of Accounts Officer.The RTI Application was related to construction work and recruitment of assistant professors in the AIIMS, Patna.The Commission erroneously refused to make recommendation to not return RTI Application in such circumstances.Previously the CIC in case No.CIC/LS/C/2010/000108 on dated 27/08/2013 had made identical recommendation which was however not clear to the point stated above.That's why a complaint to make fresh recommendation was filed by me.
