The only act which has impressed me by its provisions is the POCSO (The Protection Of Children From The Sexual offences ) Act,2012.This act has covered all proceedings for the free and fair investigation of the case.It has mentioned such proceedings which can't give accused to be acquitted and also can't give innocent to be trapped falsely.
Section 22(1) of the said act provides punishment against such third person who makes false complaint on behalf of a child.I have filed a Public Interest Litigation in the Hon'ble Supreme Court Of India by post seeking enquiry into the role of third person in making complaint and especially in the case of a whistle blower.Section 22(3) of the said act provides punishment against making false complaint against a child.Further,Section 26(4) of the said act empowers the magistrate and police to record the statement of a child in presence of audio-video electronic means.Section 27(1) of the said Act makes medical examination of the child mandatory whether FIR is lodged or not. Section 33(4) of the said acts says to ensure child friendly environment in the court and section 37 of the said act says to ensure trail of the court IN CAMERA.
If these all provisions are followed honestly,then it is sure that no innocent will be trapped falsely and on the other hand,there will be no way for the accused to be acquitted.

A BRIEF VIEW ON ARTICLE 370
जरुरी इस बात की है कि कश्मीरी का भारतीय के प्रति लगाव पैदा किया जाए।भारतीय का कश्मीरी के प्रति लगाव है ही।जरुरी इस बात की है कि अनुच्छेद 370 को चरणबध्द तरीके से हटाया जाए।सर्वप्रथम वहाँ के नागरिकों को हाईकोर्ट में अपने कानूनी अधिकार (Presently people have right to move High Court only in the matter of fundamental rights which are quite limited) के लिए याचिका दायर करने का अधिकार बहाल किया जाए और सुप्रीम कोर्ट में भी जाने का अधिकार बहाल किया जाए।न्यायालय को राज्य सरकार की कानून को समीक्षा करने का शक्ति दिया जाए।अनुच्छेद 370 में सर्वप्रथम ये संशोधन किया जाए।जब वहाँ के नागरिकों को ये सब अधिकारें दी जाएगी तो वहाँ के नागरिकों का भारतीय से लगाव बढ़ेगा।फिर अनुच्छेद 370 के अन्य प्रावधानों को हटाना भी आसान रहेगा।
